8. AI-Generated Responses
Clovie generates responses using artificial intelligence. AI-generated content may occasionally be inaccurate, incomplete, or inappropriate. You should not rely on AI-generated content for factual accuracy, medical advice, legal advice, financial advice, or any decision-making that could have significant consequences for your health, safety, finances, or wellbeing.
We work to make Clovie’s responses helpful and appropriate, but we cannot guarantee the accuracy, completeness, or safety of any specific response.
9. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:
- Implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
- Warranties that the Service will be uninterrupted, error-free, or free of harmful components.
- Warranties regarding the accuracy, reliability, or completeness of any content generated by Clovie.
- Warranties that the Service will meet your specific requirements or expectations.
10. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL WE, OUR AFFILIATES, OR OUR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR USE OF OR INABILITY TO USE THE SERVICE.
OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM OR RELATED TO THESE TERMS OR YOUR USE OF THE SERVICE SHALL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100.00) OR THE AMOUNT YOU HAVE PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, WHICHEVER IS GREATER.
Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.
11. Indemnification
You agree to indemnify, defend, and hold harmless Troy Di Lello, its affiliates, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorney’s fees, arising out of or in any way connected with your use of the Service, your violation of these Terms, or your violation of any rights of another party.
12. Termination
You may stop using the Service at any time by deleting your account through the in-app "Delete Account" option. We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice, including if we believe you have violated these Terms.

13. Governing Law
These Terms are governed by and construed in accordance with the laws of the State of Washington, United States, without regard to conflict of law principles. You agree that any legal action or proceeding arising out of or relating to these Terms or the Service will be brought exclusively in the state or federal courts located in Seattle, Washington, and you consent to the personal jurisdiction of such courts.
14. Dispute Resolution and Arbitration
14.1 Informal Resolution
Before filing any legal action, you agree to first attempt to resolve the dispute informally by contacting us at cloviesupport@clovie.care with a description of the dispute and your desired resolution. We will attempt to resolve the dispute within 60 days of receiving your notice.
14.2 Binding Arbitration
If we cannot resolve the dispute informally, you agree that any dispute arising from these Terms or your use of the Service will be resolved through binding arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules. The arbitration will be conducted in Seattle, Washington, unless you and we agree otherwise. The arbitrator’s decision will be final and binding.
14.3 Class Action Waiver
You agree that any dispute resolution will be conducted only on an individual basis and not as part of a class, consolidated, or representative action. You waive any right to participate in a class action lawsuit or class-wide arbitration against us.
14.4 Exceptions
Notwithstanding the above, either party may seek injunctive relief in a court of competent jurisdiction to protect intellectual property rights.
15. Changes to These Terms
We may modify these Terms from time to time. When we make material changes, we will notify you by updating the Effective Date above and, where appropriate, by providing notice through the Service. Your continued use of the Service after such changes constitutes acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the Service and delete your account.

You may not assign your rights or obligations under these Terms without our written consent. We may assign our rights and obligations without restriction.
16.5 Force Majeure
We are not liable for any failure or delay in performance due to circumstances beyond our reasonable control, including natural disasters, war, terrorism, riots, government action, or infrastructure failures.
